EUIPO Introduces AI Tool for Pre-Filing Trade Mark Checks

The EU Intellectual Property Office (EUIPO) just released a new the Early TM Screening tool and it’s the glow-up your trade mark filing process didn’t know it needed! Think of it as a pre-flight check that spots potential legal turbulence before you hit “submit.”

EUIPO’s Early TM Screening bundles all the usual pre-assessment checks into one clean, standalone tool you can use before starting an application. By simply entering your proposed trade mark and selecting the relevant goods and services, you get an instant read on possible conflicts—like existing EU trade marks, domain names, or company names—as well as red flags related to descriptiveness, morality, public policy, or protected designations like geographical indications. The tool then generates a downloadable report so you can refine your application or move straight into EUIPO’s filing forms with more confidence (and fewer surprises).

Some of the tool’s features are powered by AI, helping you spot issues faster and more accurately. It plugs into TMview to detect conflicting marks, flags potential non-distinctiveness or descriptiveness, and even surfaces comparable EUIPO decisions. But while the tech is smart, it’s not running wild—everything undergoes rigorous testing and human oversight before rollout. A new beta check for descriptiveness helps users catch what is statistically the most common reason for trade mark refusal in the EU, giving businesses and creators a clearer shot at securing protectable brand assets.

To round it out, EUIPO has launched a dedicated landing page with visual guides, examples, tutorials, and breakdowns of common refusal grounds—essentially a cheat sheet for anyone navigating the IP world. Early TM Screening is the first user-facing release under the EUIPO’s SP2030 plan, reflecting a push toward a “total experience model” that blends innovative tools, customer-centric design, and ethical AI.
